ผมเคยเรียนแต่จำไม่ค่อยได้แล้วครับ ไม่ค่อยได้ใช้ เลยคืนอาจารย์ไป
ส่วนตัวมองว่าระบบนี้ดีตรงที่มีการคาน-แบ่งอำนาจ/หน้าที่กันระหว่างผู้พิพากษากับคณะลูก
ที่ว่าคานคือjudgeสามารถover rulesได้ แต่ผมว่าคงเกิดขึ้นไม่น่าจะบ่อย เพราะไม่งั้นระบบลูกขุน
จะไม่ศักด์สิทธิ์ ส่วนที่ว่าแบ่งคือคนนึงดำเนินการพิจารณาคดี อีกคน(กลุ่ม)ตัดสินใจ
ตัดสินใจหลายๆคนดูน่าจะแฟร์กว่า
เป็นระบบที่ส่งเสริมประชาธิปไตยดี โดยอิงหลักเสียงข้างมาก อยากให้ไทยเปลี่ยนเป็นระบบนี้บ้างจัง

It can be a good thing but it also can be bad. This system only works if people follow the rules. You know that in a trial, the jurors cant talk to ANYBODY about the trial? even their family? Do you think Thais can do this? (not gossip?) there are more rules, but I think this one is the hardest for Thais to follow

example: It’s against the law to sing off key. It is illegal to have oral sex. Shotguns are required to be taken to church in the event of a Native American attack (SO OLD!!). You may not step out of a plane in flight.... etc etc


Anyway - there are many Thais who's come to the US for study or whatever reason and encounter those American equivalence to our red-shirt. Those Thais then embarrass of him/her own roots when asked about our Royal family / traditions. They then proceed to accept the 'modern' concept without questions. They have weak mind -

I've talked to my friend in Thailand (he's a student in US for a few years) and he started to talk about how his American friends think having Royal family are backward and he thought I'd feel the same (as I live here). I said no. If I met ANYONE who doesnt understand about our culture, I'll explain to them why we are as we are - and why we love out King so much. It's my duty as a Thai to spread our beautiful culture and to correct any misleading/lies that's been spread around here.

สาบานตน but didnt use the bible. When you สาบานตน , you can request not to use the bible. I did.

คุณหมายถึงคณะลูกขุนไม่สามารถใช้อารมณ์ความรู้สึกมาตัดสินใจ - they should not. Should and Can have different meanings.

เพราะjudge จะคอยแนะนำและวางกรอบการพิจารณาคดีโดยให้ยึดกฎหมายเป็นหลัก - The judge will give jurors several verdicts they can choose (like manslaughter (voluntary/involuntary), first degree murder, second degree murder etc..) the if the jurors find the defendant guilty, they choose which verdict to give that match best with situation. (This is also what you said?)

Yes, the judge will always instruct jurors to only consider fact. I don’t think you can base the real justice system to the TV show like Law and Order which is for entertainment.

We've talked before about bias - in court, jurors needs to put down all the bias and listen to fact. This is what they 'should' do. I'm sure not everybody can do that. So I'm sure there are cases that the emotions can change the outcome of the case (http://www.thejuryex...urors-verdicts/) Saying that, judge may over rules the jurors verdict in some case he/she think the jurors are not following the evident of fact in a civil trial or in overturning a finding of guilty in a criminal case (The judge can overturn a guilty verdict and find the defendant not guilty, but not the other way around) (From my friend google)


I'm totally not an expert and have never study law (alright, one semester in Collage doesn’t count!)- Just had some experiences in court and asked my husband questions

I think since you are สส, you should have studied some law? just saying you probably know more than me.

This is wrong. Juries act as triers of fact - The Judge will always instruct the jurors to listen to the evident - get the conclusion from the evident.

I've been to court in the US (car accident and got sued, but the 1st judge dismissed the trial because it has no basis (had jurors too but there were no real case, the second judge (second trial) said to let the case ran it course so they cannot re-file, jurors decided not guilty) so I've been through this. My case was very easy because there were no case to begin with, it was an accident but the plaintiff wanted to say I was negligent and want money from me.


Want to add that at both trials, we went to the selections of jurors (which took the whole day the first one and half a day the second trial.
And I've been called to jury duty twice.


Triers of Fact - In a jury trial, a jury is the trier of fact. The jury finds the facts and applies them to the law it is instructed by the judge to use in order to reach its verdict. Thus, in a jury trial, the findings of fact are made by the jury while the judge makes legal rulings as to what evidence will be heard by the jury and what law governs the case. Jurors are instructed to strictly follow the law as given by the judge, but are in no way obligated to do so. In some cases this amounts to jury nullification, i.e. the jury effectively re-writing the law or blatantly ignoring it in a particular case
